U.S. Couple Pleads Guilty to Harboring Filipino Alien for 10 Years PDF Print E-mail

C HICAGO (jGLi) – An American couple from Maryland initially indicted for five counts of forced labor conspiracy, attempted forced labor, document servitude, conspiracy to harbor for financial gain, harboring domestic worker for financial gain and forfeiture after enslaving a Filipina for ten years had pleaded guilty to a lesser offense of harboring an illegal alien and is likely to draw a maximum prison term of five years and a fine of $250,000 and to pay a possible restitution.

 

Alfred Edwards, Jr. and his wife, Gloria Edwards, both of 6200 Block of Richmanor Terrace in Upper Marlboro, Maryland, would have to pay “$6,716.20 in advance to satisfy the disputed” monies of the Filipino woman identified only as “T.E.” that were “misappropriated” by the couple.

 

The Edwards will also be placed under “supervised release of three years,” to pay special $100 assessment fee, and are ordered not to contact “T.E.” directly or thru third parties.

 

The plea deal was firmed up by Assistant U.S. Attorney Jonathan Lenzner on behalf of U.S. Attorney Rod J. Rosenstein of Maryland and private defense lawyers Robert C. Bonsib on behalf of Gloria Edwards and Andrew Alpert on behalf of Alfred Edwards, Jr.

 

U.S. District Court Judge Alexander Williams, Jr. of Maryland on May 29, 2012 set the sentencing on Sept. 20, 2012.

 

In Oct. 1998, Edwards arranged for T.E. who is a national of the Philippines, to enter US under false pretenses. Gloria paid $5,000 to someone to assist in obtaining T.E’s travel to and entry into US, including compensating the individual for securing T.E’s visa under false pretense.

 

The Edwards knew T.E. entered US without disclosing the facts regarding T.E’s purpose to enter US and without disclosing that T.E. would be residing with Edwards at their residence. Upon T.E.’s arrival at an airport in Virginia in May of 1999 in the company of said individual, Gloria picked up T.E. and drove her to Edwards’ home in Bowie, Maryland, where T.E. resided for most of the time until T.E. left that residence in Aug. 2009.

 

FACITATED MARRIAGE OF ALFRED EDWARDS, JR.’s BROTHER WITH DEMENTIA


D uring T.E.’s time with Edwards, both Edwards took steps to fraudulently obtain permanent residence status for T.E., including arranging a marriage to “M.R.”, knowing that the marriage was not a bona fide marriage and that it was arranged for the purposes of trying to secure lawful status in the
U.S. for T.E.

 

The indictment alleged that in early May 1999, Gloria Edwards showed money to T.E., handing it to the individual, who escorted her from the Philippines to the U.S. The individual, in turn, gave T.E.’s passport to Gloria Edwards.

 

On July 14, 1999 before T.E.’s B1 (Tourist) visa was to expire, knowing fully well that T.E. is married in the Philippines, the Edwards arranged T.E. to marry “Individual 2,” who failed to appear at an immigration hearing on Nov. 20, 2000. T.E. and Individual 2 never lived together. The Edwards later facilitated Individual 2’s divorce from T.E.

 

On Dec. 14, 2000, the Edwards facilitated T.E.’s marriage to Alfred Edwards, Jr.’s brother, who was suffering from dementia, diabetes and related conditions that required extensive care.

 

Between 2000 and 2002, T.E.’s eight children, who lived in the apartment owned by Gloria Edwards in the Philippines, Gloria Edwards demanded from T.E. to pay Edwards by cleaning house for neighbors and required T.E.’s eldest daughter to manage the apartment building without getting paid.

 

When Gloria Edwards learned that T.E’s eldest daughter was dating, Gloria ordered all T.E.’s children to vacate the apartment.

 

Between 2002 and 2006, Edwards did not pay T.E. for her work (13 hours a day at $50 a day) and did not send money to T.E.’s children in the Philippines.

 

In August 2008 after Alfred Edwards’ brother died, Alfred Edwards, Jr. fondled T.E.’s buttocks inside her underwear and became mad when T.E. screamed for him to stop. # # #

C HICAGO (jGLi) – Filipino-American Ryan Lumba, one of the 58 injured in the shooting incident inside a movie house showing the premiere of “Dark Knight Rises” last Friday (July 20), in Aurora, Colorado, is still in critical but stable condition, according to Rolly E. Guevara, president of the Philippine American Society of Colorado (PASCO).

 

Ten moviegoers were killed on the spot while one died on arrival at the University of Colorado Hospital (UCH) in Aurora while the 12th died in another hospital.

 

“Ryan is still in ICU (Intensive Care Unit) pero mukhang takot na takot pa rin at kinakalma ng mga nurses,” (but he appears scared and is being calmed down by attending nurses),” Mr. Guevara, leader of the 350-member organization, said.

 

Mr. Lumba, 17, a recent graduate of Eaglecrest High School in neighboring Centennial, Colorado, is likely to remain in the hospital for another two weeks.

 

He was one of the patients visited by President Barack Obama, a couple days after one of the deadliest shooting rampages in United States history.

 

Ryan Lumba’s parents, Remedios and Antonio “Sam” Lumba, could not be reached for comment.

 

A public-relations staff of University of Colorado Hospital, where Ryan Lumba is recovering, refused to disclose Ryan’s medical condition, citing privacy issues.

 

Mr. Guevara, a retired structural engineer, said Ryan sustained 12 shrapnel wounds in the abdomen fired from a shotgun by a suspect identified later as James E. Holmes.

 

He said Ryan was accompanied at the time by five (non-Filipino) friends inside the movie house, two of them sustained neck and leg injuries.

 

TWO OTHER FIL AMS SURVIVED UNHARMED

 

L anie Williams, PRO of PASCO, told Mr. Guevara that aside from Ryan, there were two other Filipino Americans, who were inside the crowded theater, but escaped unharmed. They were identified as Manuel Pacis, 52, an employee of the City and County of Denver, and his daughter, Priscilla, 23, and her fiancé, Chris Stempien, also 23.

 

“Manuel and Priscilla and Stempien were able to dock on the left side of the theater at the fourth row while the gunman in the front row, who turned out to be Holmes, opposite them was pumping bullets in the right side of the theater.” Guevara said.

 

The Pacis father and daughter could not be reached for comment. Although, the Pacis were not hurt, they are attending therapy session as part of the healing process.

 

A UCH spokesperson said aside from Ryan, there are still eight patients confined in the hospital, five of them still in critical condition.

 

Guevara said because Ryan’s mother, Remedios, had just recently quit her job to attend to her wheel-chair bound husband, Antonio, PASCO decided to hold a fund-raising to help out in the financial needs of Ryan.

 

He said donors may send their donations to the RYAN LUMBA BENEFIT FUND, Wells Fargo Bank, Account # 6635 068 924, Routing # 102 000 248 or snail mail the donation to Ryan Lumba Benefit Fund c/o Mrs. Remedios Lumba, 4456 S. Himalaya Court, Aurora, Colorado, 80015.

 

Part of the proceeds will go to the expenses for the construction of handicapped-compliant bathroom on the first floor as Ryan’s partially paralyzed father is struggling to go upstairs on the second floor to take a bath that would make it more challenging with Ryan being sick.

 

Guevara said relatives and friends of Ryan Lumba are also asking for prayers for Ryan’s speedy recovery.

 

The gunman killed 12 people and wounded 58 others during a midnight showing of the Batman movie “The Dark Knight Rises” at the Century 16 multiplex in Aurora, Colo., a Denver suburb.

 

In condoling with victims’ families, President Obama said that scripture states God “will wipe away every tear from their eyes and death shall be no more. Neither shall there be mourning, nor crying, nor pain.”

 

In brief remarks, Sunday, Mr. Obama said he journeyed to Colorado and to the bedsides of the victims as a representative of the entire country “to let them know we are thinking of them every day” and as a father and husband.

 

“We can all understand what it would be like,” he said.

 

The president arrived at about 3:30 p.m. local time, then went to the hospital, just a few miles from the crime scene and where 23 of the victims were taken.

 

The alleged shooter, 24-year-old James Holmes, made his first court appearance Monday. Witnesses say he entered the theater, then exited and re-entered through a side door before tossing smoke bombs or canisters of tear gas and firing several weapons, including an AR-15 rifle with a magazine that reportedly held as many as 100 rounds.# # #
