B en Menor, the principal character of the Menorgate—the main scandal in the NaFFAAgate mess—(  has come out firing – in support of his buddy, Greg Macabenta. Mr. Macabenta is the beleaguered present national chairman of the National Federation of Filipino-American Associations (NaFFAA).

The latest flare-up of the simmering NaFFAAgate erupted after Romeo P. Marquez wrote Will the NaFFAA Survive to Be the 'Voice' For Filipinos in America?

H ere is now the blow-by-blow account, unedited at that. This was the first e-mail received from Mr. Menor by this editor:

In a message dated 8/12/2009 8:30:51 P.M. Pacific Daylight Time, writes:

BR: I don't want to waste my time debating with you, twisting the truth and outright lies (but I will set the records straight, soon).  Why don't you tell the world (if you really have guts--I always believed you were nothing but a fake and a "chicken") that the final verdict in my case were: all charges were dismissed and expunged.  I know it must hurt, since you predicted from the beginning of your tirades about being so sure and righteous, I would end up in jail and that the State Attorney General was going to prosecute me, too (where are your CRAB followers now--it must feel sad to be so alone).  Unlike you, I was cleared of all charges while you were sentenced and charged with being a "liar."

I noticed you didn't include Yolanda and Dr. Tom Stern in your email list. I wonder why? Scared to face people who are decent and honest who warned you about rumormongering and being dishonest?

Also, I believe you are lying again about going to Chicago.  Remember, you challenged Perry Diaz a face-off in Chicago and you chickened out.  All your threats are nothing more than a small man crying for attention--I believe in Karmic consequences and God will some day grant your wish.

I pray to God to have pity on your soul.

T his editor then answered Mr. Menor, as per this e-mail:

In a message dated 8/12/2009 10:01:06 P.M. Pacific Daylight Time, MEDIABCLA writes:

RE: The Aw-shucks Redemption of Ben Menor

My Dear Apong Ben:

1.0    If you want redemption, you must first be really sorry, acknowledge your mistake, repent and make restitution. You cannot just confess to a priest and say 10 "Our Fathers" as your penance. Up to now you want to live in a make-believe world that your did not enter into a "No Contest" plea in a criminal case for criminal fraud (two counts). You do not realize that people know that a "No Contest" plea is the legal equivalent of a guilty plea. The charges were dismissed and expunged as a result of a plea bargain wherein you paid tons of money for restitution of the city funds diverted to the NaFFAA convention and the board-and-care expenses of your parents, among other fraudulent actions that you committed in San Jose, plus court costs. California is running out of jail space in view of many-more white-collar crooks like you and your fellow NaFFAA national executive officers being caught by the long arms of the law. This was the reason the prosecutors from the District Attorney accepted the plea bargain.

1.1    I advise you to see the movie, "The Shawshank Redemption," the 1994 American drama film written and directed by Frank Darabont that was loosely based on the Stephen King novella. Perhaps, you can make a movie out of your life story and call it, the "The Aw-shucks Redemption of Ben Menor."

1.2    If you were really my grandchild and not my adopted one, I would advise you to simply keep a low profile and relocate to another state. Stop your attempt to become the Executive Director of the Federation of Philippine-American Chambers of Commerce (FPACC) or the chairman of the NaFFAA's chapter in Northern CA -- as the FPACC and NaFFAA good people do not like to be linked to your past.

1.2.1    And start a fresh life. No matter what you do and what you say, you are a "basang papel" in our community, especially in Northern California. So, please move to another place where you will be a complete stranger. You have become too infamous in the Filipino-American community of the Bay Area.

1.2.2    Doesn't your conscience bother you that you diverted city money intended to help aging World-War II veterans and senior citizens? You diverted it to bankroll the NaFFAA convention and up to now nobody knows where you and your co-chair, Rodel Rodis, brought the convention revenues.

2.0    RE: Manang Yo and Dr. Tom Stern. I never provided them with a CC of the NaFFAA online postings because they were never included in the original list of recipients. Netiquette dictates only CCs to the original recipients. But with your permission, I will now include them in any posting that mentions you.

3.0    RE: The Perrytale writer. I stopped corresponding with him months before the Detroit NaFFAA regional convention where he challenged me to a debate. I was not supposed to attend it in the first place. I never make any challenge to anybody as I do not have to prove my writing or debating skills. I took up and finished journalism in San Beda College where I was a full-scholar for four years while the perrytale writer finished engineering in Ilocoslovakia with 12 units of English.

Finally, may I suggest, My Dear Apong Ben, to please stop mentioning God in your postings? God has always been the refuge of saints, scoundrels and sinners. What you did in San Jose was ungodly. What you and I do with our respective Gods or gods is a private matter between us, mortals, and the Almighty. And so, please keep your prayers to and for yourself and family. I am in complete peace with the world and the Great Beyond. I have more-than enough relatives and friends who are including me in their prayers.

Your adopted granduncle,

Lolo Bobby M. Reyes

In less-than an hour, Mr. Menor sent a retort to this editor’s reply:

In a message dated 8/12/2009 10:57:33 P.M. Pacific Daylight Time, writes:

BR: You're very funny with your satire.  It is so funny when I ask folks in LA about you.  I get a funny response and than anger follows.  I see you choose to spread your venom by being a coward to those I did not cc, except to Mng Yo.  I remember meeting you at a chamber meeting in So Cal and how many of the members at that meeting vehemently despised your presence.  I felt so sad for such a small man standing in the corner with no one wanting to interact with.  It must be really lonely not to have anyone in your corner.  I thank God for his blessing for affording me the many friends who came to my side and helped me get through those difficult moments.

You are welcomed to call the DA, Dolores Carr and get her opinion about my case (I bet you, you won't share with us her response to your questions).  A dismissal and expunged is just that--or maybe you can't admit what a fool you made yourself to be, after telling the whole world I was surely guilty of your trumped up charges. Quit making up stories of the outcome and deal with the facts since you failed to even show up at any of my hearings--even though you boast that you be there.  If the DA felt I was truly guilty, why did they offer me the dismissal and expunged?  Remember, I was dismissed and expunged and according to the legal experts, there was never a case against me. Of course, you failed to admit your wrong doing with your libel suit case. How sad, one has to twist the truth to generate sympathy. Yes, I pity you, not having anyone to be by your side--it must be tormenting to be despised.

Ask your friends (if they really were your friends), the CRABS, where are they now? I understand they are crabbing themselves, seeking attention and no one listening to them--Karmic consequences.

I will cc to Mng Yo because of my deep respect for the great things that she stands for. I don't need to create attention--little man.

God, I pray you take pity on this poor soul.

(Please note that my email response is not for publication or cannot be quoted in, or any of Bobby Reyes's sleazy tabloid arenas --- and of course, let's remember to include Romy Marquez in this circus of clowns and trolls for non-publication! For other journalists, you can contact Ben Menor for comments)...

First of all, why are you listening to this Bobby Reyes, who has been charged and convicted of libel (being a liar)? He has absolutely no credibility. Mwah-ha-ha-ha-ha-ha... If you believe this pseudo-journalist, then I don't know what to think of you.

And Lourdes Ceballos, remember when we met at a Fil-Am Chamber meeting somewhere here in Chicagoland and I told you that Ben Menor was most likely going to be found innocent of all charges? Imagine that. Many people had told me that your group of alleged Fil-Am media practitioners in Chicagoland had already been a lynch mob (lynching Ben Menor, crucifying him with irresponsible journalism) for many years when this case first came up --- because to this date, there are friends in Chicago who still approach me to ask if the Ben Menor case, indeed, is over. In other words, Lourdes, can you really tell me straight to my face during the upcoming NaFFAA R3 Conference that your colleagues treated Ben Menor fairly?

So, let's stick to the facts.

It's over, the Ben Menor case is over.

These trolls (check the slang dictionary online for the meaning) have nothing better to do than cast stones on a person who has truly exemplified true servant leadership in community service.

Since this troll, Bobby Reyes, insists on rehashing a dead case (with the help of the Silicon Valley CRABS who know they cannot contest my facts because I was there with them, hahahaha!), let's give you the REAL DETAILS:

1. Ben Menor, in his capacity as the event manager of the NaFFAA 2002 Conference, delegated certain tasks to certain employees and volunteers at Northside --- including me! I had to buy 400 candles in San Francisco for the final ceremonies of the convention. I was empowered to shop, too!

2. You can't even get Nenita's name down correctly. Her name is Nita Geda. The crabs had a thing for Nita. They even stalked her and did a stakeout at her home, one of the CRABS told me (Penny Aguila). Poor woman! I don't think her name should be dragged in the troll-ish home of Bobby Reyes. Imagine, "alleged mistress!" Bobby Reyes, you really have a flair for comedy! Mwah-ha-ha-ha-ha!

3. In the 2002 NaFFAA Conference, I was wondering why Tito Cortez, the ugliest CRAB of them all, at then-Northside wasn't around much. When I was employed there, I noticed that Tito was mostly nowhere to be seen while eight employees (including me) were working their derrieres off, each one of us doing the work of eight people.

To continue: Tito's actions were so inept that his grantwriting couldn't bring in any grants. So, Cheryl Platon, another employee, had to take over. I helped out, too, when I wasn't doing my regular responsibilities. His reporting to the City of San Jose sucked --- and to this day, I really perceive that he sabotaged the reporting so the accusing fingers would go to the accountable Executive Director of the center, Ben Menor (his ex-brother-in-law).

The reasons why Tito Cortez and his gang of CRABS existed:

a. Jealousy
b. Greed
c. Self-Righteousness

4. This is directed to Joseph Lariosa's irresponsible journalism --- for not being a true journalist (Many people told me that he is the "tuta" of Bobby Reyes; BR, is that true?)

- Joseph Lariosa's brand of journalism (like BobbyReyes and Romy Marquez) was very unfair and one-sided when it came to Ben Menor. It almost felt as if Joseph had a political agenda. Maybe Joseph, you and I can clear this matter up. I hate having to discredit your work.
- Ben Menor and many of those who had been employed at Northside were under a gag order during the investigation. The NaFFAA National and NaFFAA Region 8 officers were also bound by a gag order. So, every time well-meaninged people like Dr. Joy Bruce asked the national officers about what was really happening, these officers couldn't say anything.
- What Joseph could have done in his "articles" about the Ben Menor case was to say: "Ben Menor was not available for an interview because he was bound by a gag order." Joseph, give it up! Ben couldn't talk, no one could talk, period.

5. In a nutshell, this is what happened to Ben Menor:

- the two charges involving fraud and embezzlement were dismissed.
- the third charge of "overstating the hours served" at Northside was reduced to a misdemeanor after restitution was paid by Ben Menor --- and after this, the misdemeanor was expunged. In other words, "expunged" means everything pertaining to this case was removed, as if nothing had happened.

If I understand this correctly, since I'm not a lawyer, the evidence that the District Attorney gathered did not result in a conviction for Ben Menor. INNOCENT, THAT'S MY WORD.

And, let's set the record straight. It was the District Attorney who asked for a plea bargain, not Ben Menor. "No contest" was the agreement.

Why don't we leave Ben in peace --- and allow him to continue serving his community?

6. Bobby Reyes, Romy Marquez, and other trolls believe that they can spread lies on the internet, pretending that they are the harbingers of truth.

I just read this reply from Lorna. I have not read what Bobby wrote.

Bobby's obsession with NaFFAA is extremely persecutory. Despite proofs to the contrary or invalidating evidence relating to his accusation, he continues to vilify NaFFAA.
(At this point, my husband, Tim, peeked at what I just typed - this preceding statement. He blurted out and walked away from me saying, in his exact words:

"My goodness! This has been going on for 20 years!!! (Tim is wrong but maybe he just wants to express A LONG TIME as "20 years".). You guys are giving him (Bobby) too much importance!" He disappeared from behind me.

Now, I want to proceed but I decide to quit. Furthering my reply will only prolong this issue.

Hi, Ms. Bayani:

Please tell Ms. Dietz that when I wrote the Ben Menor story, it was based on court records.

I tried to get Mr. Menor’s comment because he is a friend by sending him an email but he hardly responded.

That's also the way the reporter from San Jose Mercury News did -- cover the case based on court records.

Why single me out for being "very unfair and one-sided" against Mr. Menor? Why did she not criticize the reporter from San Jose Mercury News, who also happened to be a Filipino American? Is she scared to go after the reporter of San Jose Mercury News because the reporter is representing a mainstream publication and I am not?

For her information, if there is a development in the Ben Menor case, especially the civil case that is still pending, I am free to write it based on court information. Rest assured that I will still email Mr. Menor for his comment if there is any update on the case.

Here's my unsolicited advice to Mr. Menor: If Mr. Menor cannot make any statement for fear that he might unintentionally incriminate himself, he should authorize Ms. Dietz or his lawyer to give me any statement that he feels he needed to make.

Thank you for bringing Ms. Dietz's email to my attention.

Kind regards.

Hi, Joseph:

Clarification: I did go after the Mercury News reporter.

As for what you said you had written based on court records only, I beg to differ. See my entry here:

Greg Macabenta also went to the Santa Clara Superior Court so he could write his own article about this:

I hope you have learned some valuable insights from your coverage of the Ben Menor case.

5 Tuesday, 18 August 2009 18:32
Hi, Lorna:

What happened to your pursuit of the San Jose Mercury News? Did the reporter listen to you?

To make sure that your blogs are properly covered in a court case by reporters, you should submit them in court as part of the court records so in case there is inaccuracies in your blogs, reporters will not be blamed for the inaccuracies.

If I cannot make it in court, the Sta. Clara District Attorney is accessible for comment. If not, I usually send my area correspondent/legman (Mr. Ronnie Estrada, a San Jose resident) to cover the case on my behalf. Mr. Estrada's video, still cameras and tape recorder are reliable tools to extract accurate information from Mr. Menor's or Mr. Menor's lawyers' post-court appearances and comments.

A good defendant in a court case would employ his own press relations officer (if he needs to pay the PRO he has to do so after all a PR job is also a profession) to issue a press statement in any court development in a timely manner.

In my case, because one of my outlet's deadlines is sometimes less than 24 hours (GMANews TV), I cannot wait for one or two days for Mr. Ben Menor's comments to be withheld. Otherwise my news item will become stale (bilasa na or panis na) if my competition beats me to the story.

And the press release should so state that it is authorized by Mr. Menor, himself, so Mr. Menor will have no room to disown the statement.

Take care.

Regards to Ben.

All the best!

If there is restitution that means he was ordered to pay the injuries and/or damage incurred. a prosecutor here just like in the Philippines can enter into a plea bargaining to save government resources, efforts and and man hours for the state. the defense lawyer just did a great job for getting the least penalty for his client. however, this does not mean he was totally innocent.

Dear Apo Caloy:

Thank you for your clarification.

I know as a former long-time public prosecutor in the Philippines, you also have basic knowledge of the inner workings of American legal system, which mostly based on Roman Law.

Take care.

OMG, are you an investigative journalist or not? I think not --- seriously!

I said it was the District Attorney who offered the plea bargain to Ben Menor, not Ben Menor who asked for a plea bargain.

So, being "expunged" means just that. Everything about the case is erased from the records, meaning, it's as if it never happened. That's what was explained to me. Go and ask the DA yourself. Duh!

Enough of this already... I think you folks don't have anything to write about --- that smacks of sensationalism and tabloid sleaze so you'd rather try to resurrect a dead issue --- or am I right in thinking right now that you are all little men who are needy for attention? KSP (kulang sa pansin) --- the ones who keep insisting on bringing up Ben Menor's "it's over!" case?

Yes, Elsa, Lorna and Joseph, I came to realize the meaning of OMG immediately after I hit the button. You see, I normally don't pay attention to these internet shortcuts (lingo) such as OMG, LOL or whatever.

Yes, Bart, it means "Oh, my God." But you will get to know when and how to say it if you read my article, The Question About Heaven and Hell (To Hill and Back)?

Then you have to wait till I post my latest satire, "Dietzcoveries: Sex, Lies and NaFFAAgate," wherein I describe the other meanings of "OMG." It may be one of the best satires that I would probably write in my career. It will carry a lot also of Filipiniana that may someday be viewed on the Dietzcovery, oops, Discovery Channel. LOL.

After all is said and done, Ms. Lorna will probably end up as my good friend, if not one of my favorite apos. My writings will make her a household name in the Filipino-American, Overseas-Filipino and even the Homeland-Filipino households. It will give her some semblance of immortality. For as the saying goes, the "more you hate, the more you love." More LOL. Ms. Lorna, who is a budding blogger, if not a journalist, knows also the story about P. T. Barnum, who addressed a circus (pun intended) of reporters and told them: "You can write anything about me provided you spell my name right."
